  1. GENERELT

Disse betingelser er gældende for forbrugere ved handel på NØD’s webshop: www.nodsnacks.com.

Bemærk: For at kunne købe varer via NØD’s webshop skal du: 

  • være forbruger
  • have accepteret disse handelsbetingelser 
  • forsyne os med dit navn og adresse (herunder gyldig leveringsadresse), telefonnummer, e-mailadresse, betalingsoplysninger og andre obligatoriske oplysninger samt
  • være ejer eller autoriseret indehaver af et gyldigt betalings-/kreditkort til køb af varerne
  • eller ejer af en MobilePay-konto
  1. Ved bestilling af varer via NØD’s webshop bekræfter du, at du hverken køber varer som erhvervsdrivende eller med henblik på videresalg.

    1. PERSONLIG KONTO

    Du vil skulle oprette en personlig brugerkonto. Du er selv ansvarlig for at holde dit brugernavn og password fortroligt samt for at begrænse adgangen til dit brugernavn, password og konto, og du accepterer at påtage dig ansvaret for alle de aktiviteter og køb, der sker på din konto, medmindre sådanne aktiviteter eller køb udføres af en udenforstående tredjemand, der har skaffet sig adgang til din konto på en måde, der ikke skyldes uagtsomhed eller forsømmelse fra din side.

    1. BESTILLING

    Afgivelse af ordre via vores hjemmeside er ikke en juridisk bindende aftale. Når du har afgivet en ordre via vores hjemmeside, vil vores system automatisk sende dig en e-mail, hvoraf det fremgår, hvilke varer du har bestilt. Der er alene tale om en elektronisk kvittering for modtagelse af din ordre.

    Du skal være opmærksom på, at det automatiske svar (via e-mail) ikke er en juridisk bindende ordrebekræftelse, hvorved en aftale er indgået. NØD har således mulighed for at annullere din ordre som følge af trykfejl, udsolgte varer, tekniske problemer, leveringssvigt og lignende situationer.  

    1. PRISER

    Alle vores priser er inkl. moms og afgifter, men ekskl. told og fragtomkostninger.

    Vi tager forbehold for tryk- og korrekturfejl samt afgifts- og prisændringer.

    1. BETALING

    Generelt

    Betaling for bestilte varer kan ske online ved brug af Visa, Mastercard, American Express, Apple Pay og PayPal. Der opkræves ikke gebyr ved betaling på www.nodsnacks.com webshop.

    Kortoplysningerne transmitteres SSL-krypteret mellem kunde og www.nodsnacks.com. Vi anvender betalingssystemet Stripe, som er certificeret efter PCI-standarden (se mere på https://stripe.com/docs/security/stripe). Personoplysninger (navn, adresse osv.) krypteres dog ikke.

    Beløbet hæves først på dit kort, når din ordre er bekræftet, og de bestilte varer afsendes.

    Abonnementsordninger

    Ved oprettelse af abonnementsordninger hos www.nodsnacks.com accepterer du, at der oprettes en betalingsaftale, og at NØD webshop gemmer dine kortoplysninger samt trækker betalingen automatisk fra dit betalingskort.

    Vi trækker beløbet fra dit betalingskort den første bankdag af abonnementsperioden. Efter godkendt betaling vil du via e-mail få tilsendt en kvittering på det indbetalte beløb. Hvis betalingen af dit abonnement fejler (kort udløbet, inddraget eller lign.), vil du få besked via e-mail. Derefter vil du have 8 dage til at gennemføre betalingen, før vi spærrer for din brug af abonnementet.

    Abonnementet gælder i den angivne periode, og vi trækker automatisk en abonnementsbetaling, indtil du opsiger abonnementet.

    1. LEVERING OG FRAGT

    Vi benytter forskellige leverandører afhængig af ordrens indhold og afhængig af, hvilket lager varerne sendes fra.

    Forventet leveringstid i Danmark ligger på mellem 5-7 dage fra din ordreafgivelse.

    Levering anses for sket, når varerne er kommet i din besiddelse. Der skal kvitteres for alle leverancer ved modtagelsen. 

     

    1. ABONNEMENTSORDNINGER

    Abonnementsordning mellem kunden og www.nodsnacks.com er, hvor kunden automatisk betaler for sit løbende abonnement. Abonnementet faktureres månedligt.

    Hyppigheden af ydelsen eller produktleveringen, pris og lignende kan ses under det konkrete produkt. Udover prisen på produktet skal der pålægges fragtomkostninger, der vil fremgå af hjemmesiden før betaling. Ved flytning skal der betales fragt i henhold til de nye omkostninger.

    Indgåede abonnementsaftaler er gældende, indtil de opsiges af NØD ved Nordic Food Tech Company IVS eller kunden. Opsigelse kan ske med 1 måneds varsel til udgangen af en måned, når der er gået 1 måned efter aftalens indgåelse.

    Ved en parts væsentlige misligholdelse af aftalen kan den anden part ophæve abonnementet uden varsel.

    1. KLAGEMULIGHEDER

    En klage over en vare eller tjenesteydelse købt hos os kan indgives til Konkurrence- og Forbrugerstyrelsens Center for Klageløsning, Carl Jacobsens Vej 35, 2500 Valby. Du kan klage til Center for Klageløsning via www.forbrug.dk.

    EU-Kommissionens online klageportal kan også anvendes ved indgivelse af en klage. Det er særlig relevant, hvis du er forbruger med bopæl i et andet EU-land. Klage indgives her: http://ec.europa.eu/odr.

    1. DATABESKYTTELSESPOLITIK

    Persondata

    For at du kan indgå aftale med os, har vi brug for følgende personoplysninger: navn, adresse, telefonnummer og e-mailadresse. Vi foretager registreringen af dine personoplysninger med det formål at kunne levere varen til dig og (såfremt du har givet dit samtykke til dette) til at informere dig om produkter, programmer, ydelser og kampagner, som vi tror kan være af interesse for dig. De registrerede oplysninger finder du på vores hjemmeside under "My Account".

    Når der indsamles personoplysninger via www.nodsnacks.com, sikrer vi, at det altid sker ved afgivelse af dit udtrykkelige samtykke, således at du er informeret om, hvilke oplysninger der indsamles og hvorfor.

    Som registreret hos www.nodsnacks.com har du altid ret til at gøre indsigelse mod registreringen. Du har også ret til indsigt i, hvilke oplysninger der er registreret om dig. Disse rettigheder har du efter persondataloven og henvendelse i forbindelse hermed rettes til hello@nodsnacks.com.

    Dine oplysninger videregives eller sælges ikke til tredjemand, dog videregives din e-mailadresse til fragtfører i forbindelse med afsendelse af postpakker (så du kan modtage leveringsoplysning, herunder T&T).

    Personoplysninger registreres hos NØD IVS og opbevares i 5 år, hvorefter oplysningerne slettes. Kundeoplysninger opbevares og transmitteres ukrypteret. Betalingsdata transmitteres naturligvis krypteret, se punkt 5 (Betaling), og anvendes kun til gennemførelse af din betaling for købte varer. 

    1. LOVVALG OG VÆRNETING

    Disse handelsbetingelser samt dit køb af varer fra www.nodsnacks.com er omfattet af og skal fortolkes i overensstemmelse med dansk lov.

    Eventuelle tvister eller krav, der måtte opstå i forbindelse med disse handelsbetingelser eller dit køb af varer fra www.nodsnacks.com (herunder tvister eller krav uden for kontrakt), vil skulle afgøres ved de danske domstole som værneting. Dette har ikke nogen indflydelse på den eventuelle juridiske ret, som du som forbruger måtte have til at rejse en sag ved dit lokale værneting.

    Shipping & Returns

    We deliver in Copenhagen within 5-7 days. 

    We can also deliver internationally - please request shipping information for delivery options, cut-off times and charges at hello@nodsnacks.com. 

    Our returns and exchange policy is 30 days. We are only able to refund or exchange faulty or damaged goods within this time period. For Danish customers the return and exchange policy is 2 years for limited-life items; however, your warranty is limited to the shelf life that is customary for the product concerned.

    Our cancellation policy is 14 days under the Consumer Contract Regulations. Under the CCRs we are only able to refund unopened products. Please see below for more information under Cancelling an Order.

    SHIPPING INFORMATION

    All DK orders are delivered within 5-7 days. Customers will receive an email and/or SMS with delivery information from our fulfilment partners.

    For international orders, please contact hello@nodsnacks.com for a list of countries we can ship to, transit times and shipping fees.

    Returns & Refunds

    RETURNS 

    Refunds and replacements can only be issued if:

    • The goods are damaged or defective
    • The goods were purchased directly through com
    • the goods are returned within a 14-day period from receipt 

    We are unable to refund boxes or packaging that have been opened or purchased via third-party sellers. We are also unable to refund sale items. 

    To be eligible for a return, your item must be unused and in the same condition that you received it in. It must also be in the original packaging. Shipping costs are non-refundable.

    Customers are also required to pay associated shipping fees when returning an order and are responsible for ensuring the goods arrive safely. We do not guarantee that we will receive your returned item.

    If your circumstances align with our Returns Policy, please email hello@nodsnacks.com to coordinate, using the subject line RETURNS. We also require a receipt or proof of purchase.

    Please do not send your purchase back to the manufacturer.

    There are certain situations where only partial refunds will be granted (if applicable):

     

    • Any item not in its original condition, damaged or missing parts for reasons not due to an error on our part
    • Any item that is returned more than 14 days after delivery

     

    REFUNDS

    Once your return is received and inspected, we will send you an email to notify you that we have your returned item. We will also notify you of the approval or rejection of your refund.

    If you are approved, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment within 14 working days. 

    If you haven’t received a refund, first check your bank account again. Then, contact your credit card company as it may take some time before your refund is officially posted. Next, contact your bank. There is often some processing time before a refund is posted.

    If you’ve done all of this, it is over 30 days and you still have not received your refund, please contact us at hello@nodsnacks.com.

     

    EXCHANGES

    We can only exchange items if they are defective or damaged. We are unable to replace boxes or packaging that have been opened or purchased via third-party sellers.

    Customers are required to pay associated shipping fees when returning an order for exchange and are responsible for ensuring the goods arrive safely. We do not guarantee that we will receive your returned item.

    Depending on your place of residence, the time for your exchanged product to reach you may vary.

    CANCELLING AN ORDER

    If you live in the EU, you have the right (subject to the exceptions noted below) to cancel your order under the Consumer Contract Regulations 2013 (CCRs), which govern all internet shopping.

    You must notify us of your intent to cancel within 14 calendar days from the day after you receive the goods.

    If you wish to make use of this right, please email hello@nodsnacks.com with the subject line CANCELLATION UNDER CCR, and we will send you a model cancellation form.

    You must return the goods to us at your own cost no later than 14 days after the day on which you notified us. We recommend that you insure the return shipment and retain a proof of postage as it is your responsibility to take reasonable care of the goods, and you will be liable for any damage sustained to them until we receive them back at our warehouse.

    We will refund you the full value of your order, including the original shipping costs, via the original payment method within 14 calendar days of receiving the goods back. If your card issuer has not sent you a refund within 30 days, please contact hello@nodsnacks.com.

    It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please contact us hello@nodsnacks.com.

    Privacy Policy

     

    SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

    When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. 
    When you browse our store, we also automatically receive your computer’s internet protocol (IP) address to provide us with information that helps us learn about your browser and operating system. 
    Email marketing (if applicable): with your permission, we may send you emails about our store, new products and other updates.

    SECTION 2 - CONSENT

    How do you obtain my consent? 
    When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. 
    If we ask for your personal information for a secondary reason, e.g. marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to decline.

    How do I withdraw my consent? 
    If you change your mind after giving consent, you may withdraw your consent for us to contact you and for the continued collection, use or disclosure of your information at any time by contacting us at hello@nodsnacks.com or mailing us at:

    SECTION 3 - DISCLOSURE

    We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

    SECTION 4 - SHOPIFY

    Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 
    Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.


    Payment 
    If you choose a direct payment gateway to complete your purchase, Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

    All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. 
    PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

    SECTION 5 - THIRD-PARTY SERVICES

    In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. 
    However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide them for your purchase-related transactions. 
    For these providers, we recommend that you read their privacy policies, so you can understand the manner in which your personal information will be handled by these providers. 
    In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. Therefore, if you elect to proceed with a transaction that involves the services of a third-party service provider, your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. 
    As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. 
    Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

    When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. 
    Google analytics: 
    Our store uses Google Analytics to help us learn about store visits and the pages being viewed.

    SECTION 6 - SECURITY

    To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. 
    If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

    SECTION 7 - COOKIES

    Here is a list of the cookies we use. We’ve listed them here so you can choose if you want to opt-out of cookies or not:
    _session_id, unique token, sessional, allows Shopify to store information about your session (referrer, landing page, etc). 
    _shopify_visit, no data held, persistent for 30 minutes from the last visit, used by our website provider’s internal stats tracker to record the number of visits. 
    _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, counts the number of visits to a store by a single customer.
    cart, unique token, persistent for 2 weeks, stores information about the contents of your cart. 
    _secure_session_id, unique token, sessional. 
    storefront_digest, unique token, indefinite, if the shop has a password, this is used to determine if the current visitor has access. 
    PREF, persistent for a very short period, set by Google and tracks who visits the store and from where.

    SECTION 8 - AGE OF CONSENT

    By using this site, you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and have given us your consent to allow any of your minor dependents to use this site.

    SECTION 9 - CHANGES TO THIS PRIVACY POLICY

    We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so you are aware of what information we collect, how we use it, and under what circumstances (if any) we use and/or disclose it. 
    If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue selling products to you.
